We also handle prohibited steps orders, specific issue orders, child abduction cases, special guardianship, and matters involving parental alienation. Where local authorities are involved, we represent parents and family members in care proceedings.
Under the Children Act 1989, a mother automatically has parental responsibility. A father has parental responsibility if he was married to the mother at the time of birth, or if he is named on the child’s birth certificate for births registered after 1 December 2003. Parental responsibility can also be acquired by agreement with the mother or by court order. For immigration applications, demonstrating parental responsibility is crucial for Parent route visas and where sole responsibility is claimed for child visas.
